What is nondiscrimination testing, and why might my plan fail it?

Nondiscrimination tests, such as the ADP and ACP tests, check whether a plan disproportionately benefits highly compensated employees compared to everyone else. A plan can fail when higher earners contribute at much higher rates than other employees, which may require corrective refunds or additional employer contributions. Certain plan designs, such as a safe harbor structure, can reduce or eliminate some of this testing.
